CALFRESH ADMINISTRATIVE ERROR OVERISSUANCES

Purpose

To provide instructions regarding the changes to CalFresh Administrative Error (AE) overissuances mandated by Senate Bill (SB) 1391.

 

Background

Currently AE overissuances under $35 are not established as claims for collection.  Senate Bill (SB) 1391 establishes new and different thresholds for active and discontinued CalFresh households.

 

Policy Change

SB 1391 removed the threshold for establishing an AE overissuance for households receiving CalFresh benefits.  AE overissuances will be established for claims as small as $1.

 

SB 1391 also raises the threshold for the establishment of an AE overissuance claim from $35 to $125 for claims established for households no longer receiving CalFresh benefits (closed cases). 

 

If more than one AE overissuance claim is established and is under the $125 threshold they will not be combined to create one over the threshold.  For example, if it is determined that an inactive CalFresh case has two separate $75 AE overissuances; they will not be combined to create a $150 overissuance to meet the threshold.

 

 

SB 1391 also requires that all CalFresh overissuance NOA’s include a statement of the monetary overissuance threshold.  The CalFresh AE notices have been updated.

Automation Impact

The CalFresh AE Notices will be updated to include a budget worksheet NOA (NA 1263) in the January 2014 monthly release.

 

Follow the How-To Process NSDC to process overissuances under $35 for active CalFresh cases.

Reminder: All documentation and verification used to determine an
overissuance amount must be imaged and kept in the case record.
