Recertification Prior to the End of the Five-Month Certification Period

Recertification of Transitional CalFresh households is the process of recertifying eligibility to regular CalFresh either before the end of the five-month Transitional CalFresh certification period, or at the end of the five-month certification period.

Transitional CalFresh households may ask to recertify the CalFresh case at any time during the five-month Transitional CalFresh period.

When the head of household or authorized representative (AR) contacts the county during the first four months of the Transitional CalFresh period to report a change in household circumstances, or to request to recertify the CalFresh case, the worker will explain to the household:

·      The Transitional CalFresh recertification process as explained in this Program Guide section;

·      That benefits would increase or decrease when the Transitional CalFresh is recertified to regular CalFresh; and

·      The option to withdraw the application and continue the Transitional CalFresh case if this is more advantageous to the household.

If the household wants to recertify for regular CalFresh, Family Resource Center (FRC) staff will:

·      Send the recertification packet that includes the CF 285 (Refer to  63-304.2); and

·      Inform the household they could also apply online via My Benefits CalWIN or by calling 2-1-1 San Diego.

o  Recertification requests submitted using the SAWS 2 PLUS will be accepted by FRC staff. 

o  Transitional CalFresh households re-applying for CalWORKs/ CalFresh during the transitional CalFresh period shall be provided with the SAWS 2 PLUS as required by CalWORKs program regulations (Chapter 40-100.E).

Transitional CalFresh Recertification Requirements

To recertify a Transitional CalFresh to regular CalFresh before the Transitional CalFresh period expires (during the first four months of Transitional CalFresh) the household shall:

·      Complete and file a CalFresh application, and

·      Attend a telephone or face-to-face interview, and

·      Submit required verifications.

The worker shall process the Transitional CalFresh recertification no later than 30 days following the date an FRC or ACCESS receives the application.

The first month of the new certification period will be the first day of the month following the month in which the household submitted the application for recertification (Refer to Section 63-325.3 below).

New Certification Period
 

If the household is determined eligible for regular CalFresh, the new certification period will begin the first day of the month following the month in which the household submitted the application for recertification.  The worker shall issue full benefits for that month; the Transitional CalFresh benefits already issued plus a supplement.

EXAMPLE 1

If the household applied for recertification on the 25th day of the third month of the five-month transitional period, and the household is determined eligible for CalFresh, the worker shall begin the household's new certification period on the first day of what would have been the fourth month of the transitional period.

EXAMPLE 2

The FRC receives a CalFresh application on 12/30/2011.  The applicant household has been receiving Transitional CalFresh benefits since November 2011.  The FRC is required to process this application no later than 01/27/2012 because the 30th day falls on a Sunday.  If the household is eligible for CalFresh benefits higher than its transitional benefits, the new CalFresh certification period shall start 01/01/2012.

NOTE: The worker will not require a SAR 7 to recertify the household,.

Determination of Eligibility to a New Certification Period

The following regulations apply when determining eligibility of Transitional CalFresh households to regular CalFresh:

If ...

Then the worker shall...

The worker determines that the household is entitled to CalFresh benefits higher than its transitional benefits and transitional benefits have already been issued for the first month of the certification period,

Issue a supplement for the first month of the certification period.

The household is determined to be ineligible for regular CalFresh,

Deny the application for recertification.

However, the household will continue to receive Transitional CalFresh benefits until the end of five-month certification period.

Refer to the “note” below for Notice of Action requirement.

The household is determined eligible for CalFresh, but is entitled to a benefit lower than its current transitional benefit,

Encourage the household to withdraw its application for recertification and continue to receive transitional benefits.

NOTE: If the household chooses not to withdraw its application, the worker shall deny the application and allow the transitional period to run its course.

The application for recertification is denied for any of the reasons above,

The Transitional CalFresh case will continue and the regular recertification process will be initiated the fourth month of the Transitional CalFresh certification period as required per Section 63-324.

NOTE:  The worker shall issue Notice of Action DFA 1239 when denying a recertification of ongoing CalFresh benefits and the continuation of Transitional CalFresh benefits (Refer to Section 63-321.5).  To deny an application for recertification when the household chooses to withdraw, or benefits would decrease, mark “other” on the notice and explain regular CalFresh is being denied and Transitional CalFresh is continuing because benefits would decrease.

Recertification Delay Caused by the County

If eligibility for regular CalFresh is not determined in a timely manner (i.e., within 30 days of the application) for a household that has met the required application procedures, or has not been provided an opportunity to participate within 30 days of the application (i.e., scheduling the interview late), the worker shall continue processing the application while continuing the household’s transitional benefits.

If the household is entitled to higher benefits for the first month of the new certification period (regular CalFresh), the worker shall issue a supplement (in addition to the transitional benefits already issued).

To inform the household of the discontinuance of the Transitional CalFresh case and the approval of regular CalFresh, issue Notice of Action DFA 1239.  Refer to Section 63-321.5.

Recertification Delay Caused by the Household

If the application for recertification cannot be completed because the household has failed to take a required action, the worker may deny the application for regular CalFresh immediately to be effective the 30th day following the date the application was filed. However, the household will continue to receive Transitional CalFresh benefits until the end of five-month certification period.

·      If the household fails to appear for its scheduled interview, the worker shall send a Notice of Missed Interview (NOMI) (CF 386) advising the household it is their responsibility to reschedule the interview.

·      To inform the household of the denial for recertification of ongoing CalFresh benefits and the continuation of Transitional CalFresh benefits, issue Notice of Action DFA 1239.  Refer to Section 63-321.5.
