Household Cooperation to Determine Eligibility

In order to determine eligibility to the CalFresh Program, the household or its authorized representative must:

  Complete and sign the application form

  Be interviewed; and

  Verify certain information on the application

Refusal to Cooperate

If the household, including excluded household members who are part of the CalFresh household, refuses to cooperate with the worker in completing this process, the application will be denied at the time of refusal.

  For the worker to determine that a household has refused to cooperate, the household must have been able to cooperate and clearly demonstrated that it chose not to take the actions required to complete the application process.

  If there is any question as to whether the household has merely failed to cooperate, as opposed to refuse to cooperate, the household will not be denied.

The household will also be determined ineligible when refusing to cooperate in any subsequent review of eligibility, including reviews generated by reported changes, recertifications, or as part of a Quality Control (QC) review.

Once denied or terminated for refusal to cooperate, the household may reapply but will not be determined eligible until the household cooperates.

Refusal to disclose a Social Security Number (SSN) is an exception to the denial of the entire household.When an individual required to provide his/her SSN has refused to comply, the eligibility of the other household members will not be affected.

If a noncitizen refuses to provide immigration documentation or the sponsorís information(unless they meet an exception to sponsorship provisions found in 63-157.3), the noncitizen will be considered an excluded member of the CalFresh household and his/her income, resources and deductible expenses will counted according to Sections 63-244.2 and 63-206.4.

Refusal to Cooperate with a Quality Control (QC) Reviewer

Quality Control Reviews

The Quality Control (QC) unit is responsible for conducting QC reviews as part of the Countyís Performance Reporting System.For QC reviews, a statistical sample of households will be selected from households which are participating in the CalFresh (active cases) and households for which participation was denied, suspended, or terminated (negative cases).

 

The QC review period extends from October 1st to September 30th of the next year.A household can be selected for a State or Federal review of CalFresh benefits authorized for a specific sample month. Cooperation is mandatory for both types of reviews. If a household refuses to cooperate, it is subject to State or Federal sanctions and it is ineligible to receive CalFresh.

 

Sanction Periods

If a household refuses to cooperate in a State or Federal QC review, the household will be discontinued with timely notice as instructed by QC. Failure to comply with QC is a County initiated action. Therefore the sanctioned household should be discontinued mid-quarter with timely notice. Refer to63-285.1

 

Once denied or terminated for refusal to cooperate with QC, the household may reapply but will not be determined eligible until the household cooperates with QC during the review period.If the household does not cooperate during the review period, the household will be ineligible to participate for a specified period of time (depending on the review type as explained below):

the household will not be eligible to reapply for a specified period of time after the end of the annual review period which varies depending on the type of review:

the household is not eligible to reapply until at least 125 days after the end of the annual review period (in which the refusal to cooperate with the non-federal QC reviewer occurred).

Federal;

the household is not eligible to reapply until 9 months after the end of the annual review period (in which the refusal to cooperate with a federal QC reviewer occurred).

 

EXAMPLE 1:

A household is discontinued on 5/31/12 for refusal to cooperate with a State QC review and never completes the review.The QC annual review period ends 9/30/12.Therefore, the household can reapply on or after 2/3/13, which is 125 days after 9/30/12.

 

EXAMPLE 2:

A household is discontinued on 10/31/11 for refusal to cooperate with a State QC review and never completes the review.The QC annual review period ends 9/30/12.The household can reapply on or after 2/3/13, which is 125 days after 9/30/12.

 

EXAMPLE 3:

A household is discontinued 4/30/12 for failure to cooperate with a Federal QC review and never completes the review.The QC annual review period ends 9/30/12.The household can reapply on or after 7/1/13, which is 9 months after 9/30/12.

NOTE: An applicantís household that has been sanctioned for not cooperating with QC will be required to provide verification of all eligibility requirements, including items that would normally be verified only if questionable, as specified in Section 63-117.

Non-Cooperating Household member

If ...

Then ...

a household member refuses to cooperate in a QC review.

the entire household must be discontinued from the CalFresh Program at the end of the month in which a timely and adequate notice can be provided.

Refer to 63-285.1 for information on when changes can be considered as county initiated actions.

the non-cooperating household member(s) leaves the household (household #1) during the sanction period,

the sanction will follow the non-cooperating household member(s).

If the remaining household members from the original household were not considered non-cooperating members, they will be eligible to reapply for CalFresh benefits.

the non-cooperating sanctioned household in household #1 joins another CalFresh household #2,

CalFresh household #2 becomes ineligible until the sanction ends or the non-cooperating member(s) complies with the QC review during the QC review period and CalFresh household #1ís sanction is lifted and depending on when sanction is lifted, they may have to reapply.

 

Examples

Household #1: A CalFresh household consists of a mother and father and their two children. The mother refuses to participate in the CalFresh QC review. The worker discontinues the entire household for the motherís non-cooperation with the QC review. During the course of the sanction period, the mother leaves the existing CalFresh Household (Household #1) which now consists of father and the two children and moves in with another CalFresh Household (Household #2). The mother is no longer part of Household #1 which makes the remaining members of that household eligible to reapply for CalFresh benefits without the need to wait until the end of the sanction period.

Household #2 will be discontinued from the CalFresh program and will remain ineligible until the mother cooperates, leaves this household, or after the end of the sanction period. The Notice of Action must state the specific reason for the termination of benefits.

Required Actions

Quality Control Reviewer will document in case comments the QC name, phone number and the date the sanction request was sent to the office.

Upon receipt of the email (with the case sanction request letter attached), the Corrective Action Supervisor will ensure that QCís instructions to impose the sanction are followed and timely notice is sent out to the household.
