POLICY UPDATE ON 19-YEAR OLD VOLUNTARY CAL-LEARN PARTICIPANTS

PURPOSE

The purpose of this Special Notice (SN) is to provide Cal-Learn, Eligibility and Employment Services staff a policy update regarding 19-year old voluntary Cal-Learn participants.

 

BACKGROUND

Current Cal-Learn Program states:

·         Cal-Learn serves CalWORKs recipients under 20 years of age who are pregnant or custodial parents and have not received a high school diploma or its equivalent.

·         All pregnant and custodial parenting teens under the age of 19 are mandated to participate in the Cal-Learn program (new referrals can be made for teens up to 18 and 11 months).

·         At the time the teen turns 19 years old, if he/she is enrolled and attending school full-time, the teen may elect to stay in the Cal-Learn Program as a volunteer until obtaining a high school diploma or its equivalent or until the teen reaches 20 years of age.   

·         Cal-Learn volunteer participants are held to the same participation requirements as mandatory participants and are subject to the same sanction criteria.

·         Cal-Learn volunteers who fail to provide proof of full-time school attendance/enrollment are subject to financial sanctions. 

·         Teens may remain in volunteer status until he/she turns 20 years old or requests to be discontinued from the Cal-Learn program.  At that time, the teen is required to participate in the Welfare-to-Work (WTW) Program.

 

CAL-LEARN POLICY UPDATE

Cal-Learn Policy Update: verification of full-time school attendance/enrollment is now the requirement for a teen parent to remain a volunteer in the Cal-Learn Program. 

 

At the time a Cal-Learn volunteer participant fails to provide verification of full-time school attendance/enrollment he/she may no longer be eligible to the Cal-Learn Program, and will be evaluated for a financial sanction. 

 

Upon application of a financial sanction, the Cal-Learn teen:

·         Is no longer eligible to volunteer in the Cal-Learn Program; and

·         Is to be discontinued from the Cal-Learn Program and referred to the WTW program.

 

CAL-LEARN VOLUNTEER
DETERMINATION

Teens receiving CalWORKs assistance between 19 and 20 years of age and are attending school full-time may volunteer to participate in the Cal-Learn Program by requesting and completing of the Cal-Learn Voluntary Consent Agreement form (HHSA    CL-55, Attached). 

 

The Cal-Learn Voluntary Consent Agreement form has been updated to state:

 “If I fail to submit verification of full-time school enrollment, I will be evaluated for a financial sanction and may be discontinued from Cal-Learn and be required to participate in the Welfare to Work Program.”

 

The Cal-Learn worker is to advise the volunteer participant that:

·         Verification of full-time enrollment is required to remain in a volunteer status;

·         Volunteer participants are held to the same participation requirements as mandatory participants and are subject to the same sanction criteria;

·         Failure to provide required verification may result in a financial sanction, discontinuance from Cal-Learn, and a transfer to the WTW Program;

·         Volunteer participants may request at any time to be discontinued from Cal-Learn and referred to the WTW Program.  

 

CAL-LEARN DISCONTINUANCE

A Cal-Learn volunteer may be discontinued from the Cal-Learn Program for failing to provide verification of full-time school attendance, or at the teen’s request.

 

If

Then

The Cal-Learn volunteer fails to provide verification of full-time school enrollment,

·     The Cal-Learn Program contractor will complete a CL-50 and submit to Strategic Planning and Operational Support (SPOS) to request a financial sanction review; and

·     SPOS will review the request and evaluate for a financial sanction.

Cal-Learn volunteer requests closure of Cal-Learn case and transfer to Welfare to Work,

·     The Cal-Learn Program contractor will provide the CL-56 (Voluntary Cal-Learn 19 Year Old Request to Exit the Cal-Learn Program) form to the participant for signature; 

·     The Cal-Learn Program Contractor will notify the HSS of the participant’s request; and

·     The HSS will discontinue the participant from the Cal-Learn Program and complete a WTW Referral.

 

SPOS FUNCTIONS

Upon receipt, SPOS will review the CL-50 and CalWIN entries to approve/deny financial sanction requests, to ensure:

 

·         42-763 Eligibility and Program Participation Requirements

o        Full-time enrollment criteria is met;

·         42-766 Case Management Services

o        Monitor the teen parent through monthly direct contact;

o        Contact the teen within a 10-day ‘reasonable effort’ period if he/she fails to provide required school verification;

·         Cal-Learn Notice of Participation Problem, CL-3 sent timely to the teen;

·         Case Comments.

 

Upon completion of sanction review, the following will occur:

 

If the Financial Sanction is

Then SPOS will

 

Approved

·     Complete and distribute the CL-50 to the Cal-Learn contractor with notification of the sanction approval.

·     Complete and distribute the CL-54 to the Human Service Specialist (HSS) with instructions to apply the financial sanction.

·    Follow up with the HSS to ensure the sanction is imposed.

o   Once applied by HSS, refer the teen to the WTW program.

 

Denied

·    Complete and distribute the CL-50 to the Cal-Learn contractor with notification of the sanction denial.

 

 

CAL-LEARN CONTRACTOR FUNCTIONS

Upon receipt of the CL-50 from SPOS, the following will occur:

The Conclusion of Cal-Learn Participation, section 42-766 of the Cal-Learn Program Guide, requirements are to be followed and appropriate notifications to the Cal-Learn teen are to be sent by the Cal-Learn contractor.

 

Denied

 

The teen will remain an active Cal-Learn participant and case management services are to be continued by the Cal-Learn contractor.

 

 

ELIGIBILITY FUNCTIONS

The Cal-Learn Program has three penalties that may be applied to a teen parent:

No good cause reason for unsatisfactory progress on report card.

$50 x 2 months

Did not provide report card within 10-day reasonable effort period.

$50 x 2 months

Report card submitted late without good cause.

$25 x 2 months

 

The HSS is responsible for completing the following CalWIN entries for each type of Cal-Learn penalty, as stated on the CL-54 distributed by SPOS:

 

1.      Penalty Reason: Teen has no good cause reason for unsatisfactory progress on report card

Penalty Amount/Duration:  $50 x 2 months

WTW FUNCTIONS

At the time SPOS approves a Cal-Learn financial sanction and refers the participant to the WTW program, WTW staff is responsible for receiving the new referral and scheduling the participant to an Orientation appointment.

 

New WTW referral process is completed in two steps:

PROGRAM IMPACT

No impact to Food Stamps or Medi-Cal programs.

 

CHILDCARE IMPACT

The Cal-Learn contractor is to send a 27-128 informing the Childcare Case Manager that the Cal-Learn teen has failed to provide verification of full-time enrollment and a sanction review has been requested.

 

FORM IMPACT

The following forms have been loaded on iWAY for immediate use:

·         Cal-Learn Voluntary Consent Agreement Form (HHSA – CL-55)

·         Voluntary Cal-Learn 19 Year Old Request to Exit the Cal-Learn Program (HHSA – CL-56)

These forms are not in the CalWIN system and only available through shelf-stock.

 

AUTOMATION IMPACT

No impact

 

QA IMPACT

Quality Assurance will cite case accuracy errors should the procedures in this notice be incorrectly/not applied.  Quality Assurance will cite benefit errors should participants be incorrectly sanctioned or incorrectly aided based on the erroneous interpretations of this Special Notice.
