ELIGIBILITY FOR AID AND SERVICES FOR NON-CITIZEN VICTIMS OF HUMAN TRAFFICKING, DOMESTIC VIOLENCE AND OTHER SERIOUS CRIMES – SB 1569 SOCIAL SECURITY NUMBER REQUIREMENT

Purpose

The purpose of this Addendum is to inform staff of the Social Security Number (SSN) requirement exemption for those individuals applying for CalWORKs and/or Food Stamp benefits who claim the status of a victim of human trafficking or other serious crimes pursuant to Welfare and Institutions Code Section 18945.

 

Background

The federal requirement that individuals provide SSNs in order to receive federal Temporary Assistance for Needy Families (TANF) funding and Food Stamp benefits was established for the purpose of preserving program integrity through the use of the Income Eligibility Verification System (IEVS). 

 

Applicants and recipients of federally funded TANF and Food Stamp benefits are required to disclose their SSNs as a condition of eligibility.  However, under SB 1569, individuals claiming the status of a victim of human trafficking or other serious crimes are state-funded and are not governed by this federal requirement.

 

Therefore, victims of trafficking or other serious crimes do not have to provide or apply for a SSN as a condition of eligibility for state funded CalWORKs or Food Stamp benefits.

Once the trafficking victim has been certified by the Office of Refugee Resettlement (ORR), he or she will be eligible for federal benefits and as a condition of eligibility, must apply for a SSN.

 

Automation Impact

Specific field entries are required in order for CalWIN to determine eligibility correctly for this specific population (see Program Specific Guidelines and the CalWIN Entries sections of CalWORKs and Food Stamps FSPG Joint SN 07-03).  Additionally, CalWIN does not allow for the entry of pseudo social security numbers.  Refer to the BENDS for CR3577, “PRUCOL Aliens With No SSN”, on the CalWIN intranet for automation instructions for individuals who do not have a SSN.

 

Quality Assurance (QA) Impact

Quality Assurance staff will cite the appropriate error when the instructions in this Special Notice are not applied or are applied incorrectly.
