CHILD SUPPORT PAYMENT AND DISTRIBUTION CHANGE

PHASE II

Effective Date

Purpose

The purpose of this CalWORKs Program Guide Special Notice is to advise Family Resource Center (FRC) staff of phase II of the scheduled changes to the child support collection and payment distribution.

 

Background

Federal Law requires California to have a central location responsible for the collection and distribution of child support payments.  Currently our Local Child Support Agency (LCSA) is responsible for this process.

 

The Department of Child Support Services (DCSS) is meeting that requirement by establishing and implementing the State Disbursement Unit (SDU), located in Sacramento. The SDU will serve as the central location responsible for statewide collection and disbursement of child support payments.

 

In the initial phase which began in March 2006, our LCSA began forwarding all child support collections to the SDU for disbursement.

 

Phase II

Beginning August 2006, all child support payments statewide must be sent directly to the SDU from the obliged and will no longer be sent by the LCSA. The LCSA will continue to accept any hand delivered payments and forward them to the SDU for processing.

 

Split Child Support

Effective August 2006, all orders for child support will be known to the SDU. If a Non-Custodial Parent (NCP) has multiple support obligations, child support collections could be split between counties.

 

Example:

 

Two CalWORKs aided children in separate counties. The court order obligates the NCP to pay $250 to each child. The NCP is paying only $250 to the SDU for one child. Effective August 2006, the $250 would be split between counties with each Custodial Parent (CP) receiving a $50 Child Support Disregard.

Split Child Support Disregard

In rare situations, the Child Support Disregard Payment when split between counties, could result in a disregard payment of less than $50.

 

Example:

 

Two CalWORKs aided children in separate counties. The court order obligates the NCP to pay $100 to each child. The NCP pays only $50 for one child. Effective August 2006, this $50 would be split between counties. As the amount collected is $50, each CP would receive a $25 Child Support Disregard from the SDU.

 

Reminder: The Child Support Disregard Payment is not counted in the CalWORKs budget.

 

LCSA Responsibility

The LCSA is responsible for customer service for child support case inquiries.

 

Any inquiries received by the Human Services Specialist (HSS) regarding the transition to the SDU, delays in payments, or any other inquiries related to this transition must be directed to the LCSA. The LCSA contact phone number is:
