Purpose

The purpose of this letter is to inform CalWORKs staff of the updates to the following CalWORKs Program Guide (CPG) Chapters:

         44-350 B. Definitions

         44-350 C. Investigation of Overpayments

         44-350 D. Aid Paid Pending

         44-350 E. Methods of Overpayment Recovery

         44-350 F. Overpayment Calculation

         44-350 G. Overpayment Recovery

         44-350 H. Mandatory Inclusion Overpayment/Underpayment

         44-350 I. Overpayment Recomputation Method

         44-350 J. Intentional Program Violation (IPV)

This CPG Letter also obsoletes CPG Special Notice 06-06 Revenue and Recovery Manual Referral Process.

 

Overpayment Collections from Minors

California Department of Social Services (CDSS) issued ACL 12-02. Family Resource Center (FRC) staff shall not take collection actions via grant adjustment, tax intercept or other collection methods, and to prospectively forego pursuit of repayment from adults or emancipated minors who were minors receiving cash aid in an assistance unit when an overpayment occurred.

 

Further instructions will be issued under separate program material regarding specific procedures and processes outlined by the issuance of ACL No. 12-23.

When there is an OP/UP due to a change in a quarterly report, the ACCESS agent will follow up the necessary steps to complete the OP/UP process.

 

CalFresh Program Impact

CalFresh Program issued CalFresh Program Guide Letter No. 572 to inform staff of the revisions and updates to the Claims and Adjustments chapter 63-450 and to implement procedures relating to Intentional Program Violations (IPVs) as specified in the settlement for the Lopez v. Wagner lawsuit.
