USE OF SWORN STATEMENTS BY VICTIMS OF DOMESTIC ABUSE/DOMESTIC VIOLENCE TO ESTABLISH ABUSE

Purpose

The purpose of this CPG Letter is to inform CalWORKs Eligibility and Employment Services staff of updates to CPG sections 10-011 F. and 40-100 O. These sections are being updated to provide additional clarification regarding the treatment of Domestic Abuse/ Domestic Violence victims and the use of Sworn Statements.

Background

State regulations establish that sworn statements by a victim of abuse are sufficient to establish abuse unless the county can document an independent and reasonable basis to find that the individual is not credible.
