Establishing an Overpayment (OP) Claim

CalWORKs overpayments (OPs) will be based on the following:

         Failure to report or late reporting of any mandatorily required information as required per CPG 44-260.D;

         County error; and

         The County not being able to issue the correct grant amount due to insufficient time to issue a 10-day notice.

If any of the above situations occur and the Assistance Unit (AU) was issued benefits to which they were not eligible, then an OP will be calculated for the appropriate months per CPG 44-350.I.

10-day Waiver

For CalWORKs, the recipient has the option to sign a 10-day waiver to avoid a potential OP. The Human Services Specialist (HSS) will inform the recipient of this option prior to calculating an OP whenever possible.

Signing the waiver acknowledges that the recipient has agreed to a decrease or discontinuance of CalWORKs without timely notice.

County-Initiated Action

When it is determined that an overpayment has occurred, action will be taken to correct the CalWORKs grant amount and begin collection efforts via grant reduction with timely notice.

If a prior OP claim is currently being recouped, then grant reduction for the new claim will not begin until after the prior OP has been collected.

Example: Mandatory Change Reported Late

Scenario

A CalWORKs AR/CO AU has a 12-month certification period: June May.

On September 5th, the AU receives income over their IRT.

The recipient contacts the County to report the income change on November 5th.

The change results in a decrease in CalWORKs.

Outcome

CalWORKs will be decreased effective December 1st with timely and adequate notice.

An OP will be established for October and November because the change occurred in early September.

If there is no prior OP being collected, then recoupment for this OP claim will begin via grant reduction effective December with timely and adequate notice.

If the change had been reported timely within 10 days, CalWORKs would have been decreased effective October 1st with timely and adequate notice.
