Reported Information on the QR7

Recipients are required to provide information and answers to all questions and items on the QR 7 and attest, under penalty of perjury, that they have truthfully reported all required information.Recipients are required to report all income received for the QR Data Month, any changes in Assistance Unit (AU) composition or property since the submission of the last QR 7, and any changes in income the recipient anticipates will occur in the upcoming Payment Quarter.

 

Additionally, all required verification must also be submitted with the QR 7.†††††

 

Note:

The Human Services Specialist (HSS) will presume that all income and eligibility information reported on the QR 7 was known by the recipient in the Data Month.However, if other information received by the HSS indicates that the recipient-reported changes on the QR 7 were not known to the recipient until after the Data Month, the change will be treated as a voluntary mid-quarter report.††

 

QR7 Due Date

 

 

 

 

Top

A completed QR 7 is due by the 5th of the month and is considered timely if received by the 11th calendar day of the QR Submit Month.

 

The QR 7 cannot be received or dated before the first calendar day of the QR Submit Month.If the QR7 is received or dated before the first calendar day of the QR Submit Month, it will be considered incomplete.

 

Criteria for Evaluating Information Reported on the QR7

For CalWORKs purposes, a QR 7 is complete when the following

requirements are met:

 

        The date the QR 7 is signed is no earlier than the first day of the QR Submit Month.

 

        The address along with other information provided on the QR 7 is sufficient for county administrative purposes, including the ability to locate the recipient.

 

        The QR 7 is signed under penalty of perjury by each natural or adoptive parent or aided spouse of a parent or other caretaker relative living in the home, unless an individual so specified is temporarily absent from the home.

 

        The information provided on the QR 7 together with the submitted evidence is sufficient for the HSS to determine eligibility and/or grant amounts. This includes the income and any change in resources of a stepparent living in the home, and any person who is required to apply for aid but is excluded from the AU. Reported income will include earned, unearned, exempt, and nonexempt income received during the QR Data Month and income reasonably anticipated to be received during the next QR Payment Quarter.

 

        Evidence submitted with the QR 7 verifies the gross amount of all earned income received and the date of receipt. Evidence submitted verifies the initial receipt of or a change in the amount of unearned income received. Such evidence includes but is not limited to: pay stubs, letters of award or benefits (such as unemployment, disability, or Social Security).Original documents and records submitted with the QR 7 will be promptly returned to the recipient.

 

        Information reported on the QR 7 is consistent with other information, which the HSS has verified to be accurate.

 

The QR 7 is required to include the Sponsorís Quarterly Income and Resources Report (QR 72) when the recipient is a sponsored non-citizen.

 

The Senior Parent Quarterly Income Report (QR 73) is required to be submitted with the QR 7 when a minor parent lives with his/her senior parent.The completeness of the QR 73 will be determined using the criteria for evaluating the completeness of the QR 7.

 

Note:

The failure to report or verify the receipt of a child/spousal support disregard payment issued will not result in an incomplete QR 7 or in termination of aid.

 

Resolving
QR 7 Discrepancies

When the QR 7 is received, it will be compared to any mid-quarter reported information to ensure that the information is consistent.The HSS will take action to resolve discrepancies between information reported on recipient mid-quarter reports and information reported on the QR 7.

 

The HSS will first attempt to contact the recipient to resolve the discrepancy and if the HSS is unable to contact the recipient or obtain resolution from such contact, the QR 7 will be considered incomplete.

 

Incomplete QR7

If the QR 7 is received by the 11th day of the QR Submit Month (third month of the quarter) and it is determined to be incomplete, the HSS will send a timely discontinuance notice to the recipient (Y Notice) detailing why the QR 7 is incomplete.Benefits will be discontinued at the end of the QR Submit Month if the recipient fails to submit a complete QR 7 by the extended filing date which is the first working day of the following month.

 

If a complete QR 7 is later received in the month after a QR 7-related discontinuance, the HSS will determine if Good Cause exists per CPG 44-250 C.If Good Cause does not exist and the discontinuance cannot be rescinded, the HSS will process a restoration of aid per CPG 40-125 B, if all eligible criteria are met.

 

Note:

The HSS will take action to resolve discrepancies between information reported on recipient mid-quarter reports and information reported on the QR 7. The HSS will first attempt to contact the recipient to resolve the discrepancy and if the HSS is unable to contact the recipient or obtain resolution from such contact, the QR 7 will be considered incomplete.

 

Late QR7

If ...

Then ...

The QR 7 is NOT received by the 11th day of the QR Submit Month, it will be considered late.

 

A discontinuance notice (X notice) will be sent to the recipient. For late QR 7s, an overpayment will be established when a recipient submits a late QR 7, resulting in the receipt of more benefits than entitled because of the inability to issue 10-day notice*.

The QR 7 is received (and is considered complete) after the 11th of the QR Submit Month but on or before the extended filing date (the first working day of the following month)

 

The HSS will rescind the discontinuance and the clientís benefits will be reinstated at the prior level.

 

There is no time for a 10-day notice to decrease benefits by the 1st month of the upcoming quarter

 

The HSS will decrease benefits for the 2nd month of the upcoming or next quarter.

There is an increase in benefits

 

A supplement will be issued for the first month and benefits will be increased for the remaining two months of the QR payment quarter.

 

A complete QR 7 is not received by the end of the month following discontinuance

 

 

The discontinuance will remain in effect.The recipient will reapply for aid, unless:

        Good Cause is established, or

        A complete QR 7 is received within the month after the QR 7-related discontinuance.

A complete QR 7 is received within the month after a QR 7 related discontinuance and Good Cause exists

The QR 7 discontinuance will be rescinded and benefits will be restored back to the first of the month, following the month of discontinuance.

A complete QR 7 is received within the month after a QR 7-related discontinuance and Good Cause does not exist

Benefits will be restored and prorated based on the date the complete QR 7 is received.

* Under QR/PB, the CalWORKs program allows recipients the opportunity to waive the 10-day notice requirement in order to avoid incurring an overpayment in their case. Waiver of the 10-day notice provision will allow the HSS to decrease or discontinue benefits without having to provide a timely (10-day) notice to the AU.

 

 

Personal Contact (Balderas)

After sending the discontinuance notice for failure to submit a complete QR 7 (no later than 10 days before the end of the Submit Month) a personal (Balderas) contact with the recipient, either in person (Face-to-Face) or by telephone will be attempted.During the personal contact, the recipient will be reminded that a complete QR 7 is required to be received no later than the first working day of the next QR Payment Quarter.The contact attempts (of how and when the contacts were attempted or made) will be narrated in the case comments.

 

If the recipient is unable to be contacted, a written Balderas Reminder Notice will be mailed no later than 5 business/work days prior to the last calendar day of the QR Submit month.

 

As listed above, the late QR 7 sequence is:

 

1.    Discontinuance notice

2.    Balderas contact attempt (either in person or by telephone)

3.    If unable to contact, send written Balderas Reminder Notice

 

Note: Under no circumstances shall the reminder notice be mailed in the same envelope as the discontinuance notice.

The Balderas Reminder Notice will be automatically sent to the recipient through the CalWIN batch process if the recipient was unable to be contacted.The Balderas Reminder Notice can also be manually generated by the HSS on-line.The HSS can refer to the Batch Calendar, located on the CalWIN Intranet, for monthly auto and on-line Balderas notice dates.

 

Note:

A CalWORKs termination for an incomplete QR 7 is not valid unless an attempted Balderas personal contact is made and documented in the case file and a Balderas Reminder Notice is sent if contact cannot be made.
