The Employment Case Manager (ECM) must review the Learning Disabilities (LD) Report to determine if there are any learning disabilities or other co-existing conditions (i.e. substance abuse, mental health, domestic violence, and other disabilities).ECMs must:

 

      Enter all the appropriate, required CalWIN LD Coding; and

       Incorporate the findings of the LD Report into the participantís

†††† Welfare-to-Work (WTW) activities. 

 

No LD Present
 
 

If the written LD Report establishes that the participant does not have a learning disability, the ECM must inform the participant of the findings and the participant must begin/resume the normal, required WTW activities.The ECM must also enter the required CalWIN LD Coding.

If the LD Report reveals that the participant has one or more learning disabilities, the ECM must take all of the following actions:

Incorporate results and recommendations from the LD Report into the participantís WTW Plan, which is to be developed jointly with the participant; and

2

Provide the participant a copy of the report in his/her primary language and in a format that accommodates his/her learning disability; and

3

Explain to the participant the testing results and recommendations for reasonable accommodations provided in the LD Report; and

4

Discuss the appropriate WTW activities and reasonable accommodations necessary to help the participant be successful in his/her WTW activities.

 

NOTE:The ECM must exercise caution not to limit the range of services or WTW activities simply because of the participantís LD; and

5

Develop or modify the WTW Plan to reflect appropriate WTW activities and necessary reasonable accommodations, based on mutual agreement between the CalWORKs Program and the participant; and

6

Provide the participant with written verification of his/her learning disability(ies) that he/she can present to employers, schools, and other entities to demonstrate the need for reasonable accommodations.

 

NOTE: LD Specialist will attach this written verification to the LD Report for all participants with learning disabilities.

Enter case comments to document the results of the LD Evaluation.

If the LD Report reveals that the participant may have other conditions, including but not limited to physical, mental, developmental, or behavioral conditions, the ECM must:

Refer the participant for evaluation and treatment/services for the condition(s);

Incorporate the treatment/services into the WTW Plan;

4

Enter case comments regarding the results of the LD Evaluation; and

Examples of other conditions include, but are not limited to, substance abuse, mental illness, domestic violence, and developmental delays.

 

NOTE:Other conditions must be addressed whether or not they occur with or without a co-existing learning disability. 

 

 

 

Supportive Services
 
 
 

The costs of providing necessary reasonable accommodations may be paid for with ancillary supportive services.The ECM and the participant should also consider other funding sources to pay for needed accommodations, including but not limited to community colleges (if the participant is enrolled in the college) and employers (if the participant is working).

 

Initial Job Search
 
 

Upon completion of WTW Intake Appraisal, ECMs assign all participants to Initial Job Search as the first WTW activity, except those listed under Exclusions.Participants who will not benefit from Initial Job Search due to verified LD are not required to participate in Initial Job Search as their first WTW activity.

In determining whether or not Initial Job Search is beneficial for a WTW participant with verified LD, the ECM must consider, at a minimum, all of the following factors on a case-by-case basis:

 

   The employability skills of the participant;

   Whether available jobs in demand occupations in the local area

†† are suitable to the participantís skills;

   The participantís employment history and the effect that LD may have had on the individualís work history (i.e. numerous short-term, low-wage jobs); and

   Whether or not the participant is aware of the types of jobs and job-settings in which s/he can likely obtain and retain employment.

 

If the ECM determines that Initial Job Search will not be beneficial for a WTW participant with documented LD, the ECM must advise the participant of the reasons for this determination.†† The ECM must also promptly refer the participant to an LD Evaluation, if the participant has not yet been referred.

 

Even if the ECM determines that the participant will not benefit from Initial Job Search due to verified learning disabilities, participants may choose to participate and may not be denied the opportunity to do so.

For participants with verified learning disabilities, who either chose to participate in Initial Job Search or have been enrolled in Initial Job Search based on the ECMís determination that they may benefit from the activity, the ECM must take all of the following actions:

Read the Learning Disabilities Initial Job Search Scheduling Letter to the participant; and

4

Enter case comments in the WTW case to document that the scheduling notice was issued and read out loud to the participant.

Once a WTW participant with verified LD is placed in Initial Job Search either at the participantís choice or through the determination by the ECM that the participant may benefit from the activity, the participant will be subject to the same requirements and have the same rights as other participants.

 

If Initial Job Search proves not to be beneficial for the participant, the ECM must:

Schedule the participant for an appointment to schedule a new WTW activity;

Issue the participant the Initial Job Search Shortened/Schedule New Activity ;

3

Issue the participant all appropriate supportive services discontinuance NOAs, including but not limited to child care and transportation; and

4

If the participant is receiving childcare supportive services, communicate the changes in the childcare status to the participantís Child Care Case Manager.
